The Tickle Box Affiliate Program Terms & Conditions

Welcome to The Tickle Box Affiliate Program. We value our affiliate partners and want to build relationships that are transparent, fair, and beneficial for everyone involved.

By participating in The Tickle Box Affiliate Program through Shopify Collabs, you agree to the following Terms & Conditions.

1. Affiliate Program Eligibility

Participation in The Tickle Box Affiliate Program is subject to application and approval.

The Tickle Box reserves the right to approve or decline any application and may discontinue an affiliate relationship if the affiliate no longer meets our program standards or violates these Terms & Conditions.

Affiliates must be at least 18 years old and legally able to participate in an affiliate marketing program in their jurisdiction.

2. Affiliate Commission

Unless otherwise stated in your individual affiliate offer, approved affiliates earn 10% commission on qualifying referred sales.

Commission is generally calculated on the eligible merchandise value after applicable discounts and excludes amounts such as shipping charges, taxes, refunds, returns, cancellations, chargebacks, and other non-qualifying amounts.

Certain products, promotions, orders, or transactions may be excluded from commission eligibility.

From time to time, The Tickle Box may offer select affiliates increased commission rates, performance incentives, special campaigns, or other opportunities.

3. Personalized Affiliate Links and Codes

Approved affiliates may receive a personalized affiliate link and/or discount code through Shopify Collabs.

Under our standard affiliate offer, customers may receive 10% off eligible purchases when using an affiliate's personalized offer.

Affiliates are responsible for sharing their links and codes accurately and may not modify, misrepresent, or distribute unauthorized promotional offers.

4. Referral Tracking

The standard affiliate referral window is 90 days.

When a customer visits The Tickle Box through an affiliate link, Shopify Collabs may attribute an eligible purchase to that affiliate during the applicable tracking period.

Tracking and attribution depend on Shopify Collabs and related technologies and may be affected by browser settings, cookies, privacy settings, customer behavior, or other technical circumstances.

The Tickle Box cannot guarantee attribution when tracking information is unavailable, blocked, deleted, or otherwise unable to identify the referring affiliate.

5. Sales, Promotions and Discount Codes

The Tickle Box may periodically offer sales or promotional discounts that provide customers with a greater discount than the standard affiliate offer.

Affiliate discounts generally cannot be combined with other promotional discounts unless explicitly stated otherwise.

During promotional periods, customers may use an eligible Tickle Box promotional code instead of the affiliate's standard customer discount.

A qualifying referred purchase may still generate affiliate commission when attribution is successfully maintained, even when an eligible Tickle Box promotional code is used.

Commission is based on the qualifying sale amount after applicable discounts.

6. Returns, Refunds and Cancellations

Commission is not earned on purchases that are ultimately determined to be ineligible.

Commission may be canceled, reversed, or adjusted for transactions involving:

• Returns or refunds

• Canceled orders

• Chargebacks or payment disputes

• Fraudulent transactions

• Duplicate or erroneous transactions

• Unauthorized purchases

• Self-referrals or other prohibited transactions

If commission has already been credited for a transaction that later becomes ineligible, the commission may be adjusted or reversed.

7. Commission Holding Period and Payments

Qualifying commissions are subject to a 30-day holding period before payment processing.

The holding period allows time for returns, refunds, cancellations, chargebacks, fraud reviews, and other order adjustments.

Affiliate payments are processed through Shopify Collabs and are also subject to Shopify's applicable payment requirements, policies, processing schedules, and supported payment methods.

8. Affiliate Disclosure Requirements

Affiliates must clearly disclose their relationship with The Tickle Box whenever promoting our products or services.

Disclosures must comply with applicable advertising laws and regulations, including applicable Federal Trade Commission endorsement and advertising disclosure requirements.

Disclosures should be clear, noticeable, and placed where consumers are likely to see them.

Examples may include:

“I may earn a commission if you purchase through my link.”

or clear designations such as #ad or #affiliate, when appropriate.

Affiliates are responsible for understanding and following the disclosure requirements applicable to their content and audience.

9. Content and Brand Standards

The Tickle Box is an adult wellness and intimacy brand. Affiliate content should reflect our commitment to tasteful, responsible, inclusive, and consensual adult experiences.

Affiliates may not promote The Tickle Box through content that:

• Is directed toward minors or intentionally targets audiences under 18.

• Promotes non-consensual sexual activity, exploitation, abuse, or illegal conduct.

• Contains deceptive, fraudulent, discriminatory, threatening, or intentionally misleading claims.

• Misrepresents The Tickle Box, its products, pricing, promotions, or policies.

• Makes medical, therapeutic, or health claims about products that have not been expressly authorized by The Tickle Box.

The Tickle Box may request removal or correction of content that inaccurately represents our brand or products.

10. Prohibited Promotional Methods

Unless The Tickle Box provides prior written permission, affiliates may not:

• Send unsolicited commercial email, text messages, or other spam promoting The Tickle Box.

• Use cookie stuffing, forced clicks, hidden redirects, misleading links, or similar techniques designed to generate artificial attribution.

• Bid on The Tickle Box's company name, trademarks, domain name, branded product terms, or confusingly similar variations in paid-search advertising.

• Create websites, domains, social-media accounts, or advertisements that impersonate The Tickle Box or could reasonably appear to be official company properties.

• Publish affiliate codes on coupon, discount, deal, or code-aggregation websites without authorization.

• Promote expired, unauthorized, altered, or private promotional codes.

• Generate fraudulent transactions, artificial traffic, or other activity intended primarily to generate commission.

11. Self-Referrals

The affiliate program is intended to reward affiliates for introducing and referring customers to The Tickle Box.

Affiliates may not use their own affiliate link or discount code to generate commission on their own purchases or otherwise create transactions primarily for the purpose of earning affiliate commission.

12. Intellectual Property

The Tickle Box may provide approved logos, graphics, product images, promotional materials, or other brand assets for affiliate use.

These materials remain the property of The Tickle Box or their respective rights holders.

Affiliates may use approved materials solely for purposes of promoting The Tickle Box under this program and may not materially alter our trademarks, logos, or branding in a manner that misrepresents the brand.

Participation in the affiliate program does not transfer ownership of any The Tickle Box intellectual property to the affiliate.

13. Affiliate Content, Collaborations and Promotional Use

From time to time, The Tickle Box may invite affiliates to participate in features, collaborations, interviews, social-media content, email campaigns, product launches, promotional campaigns, or other marketing opportunities.

Participation in these additional opportunities is voluntary unless otherwise specified as part of a particular campaign or agreement.

13.1 Content Use Authorization

If an affiliate expressly agrees, opts in, or otherwise provides permission for The Tickle Box to use content created or provided by the affiliate in connection with The Tickle Box, its products, an affiliate campaign, or a promotional collaboration, the affiliate grants The Tickle Box a non-exclusive, royalty-free, worldwide license to use, reproduce, display, publish, repost, share, distribute, and promote that approved content for The Tickle Box's marketing, advertising, promotional, social-media, website, email, and other brand-related purposes.

This permission includes use of the affiliate's name, social-media handle, account name, image, likeness, voice, or other identifying information to the extent included in or reasonably necessary to present the approved content, unless otherwise agreed in writing.

13.2 Reliance on Affiliate Authorization

Once an affiliate has expressly opted in or granted permission for such use, the affiliate acknowledges that The Tickle Box may rely on that authorization when creating, scheduling, publishing, distributing, or otherwise using marketing and promotional materials.

The affiliate may not subsequently object to, demand compensation for, or require removal of uses made in accordance with the permission originally granted, except where required by applicable law or where The Tickle Box has agreed otherwise in writing.

The affiliate retains ownership of their original content. Permission granted to The Tickle Box does not transfer ownership of the affiliate's content to The Tickle Box.

13.3 Withdrawal of Permission

Unless a separate campaign agreement states otherwise, an affiliate may request that The Tickle Box discontinue new uses of their content by providing written notice.

Any withdrawal of permission will apply prospectively. It will not require The Tickle Box to recall, destroy, remove, modify, or discontinue marketing or promotional materials that were created, published, distributed, scheduled, printed, or otherwise put into use before the withdrawal became effective, except where required by applicable law.

The Tickle Box may maintain reasonable archival records of previously published campaigns, posts, communications, and promotional materials.

14. Independent Relationship

Affiliates participate in The Tickle Box Affiliate Program as independent participants.

Nothing in these Terms & Conditions or in an affiliate's participation in the program creates an employment, agency, franchise, joint venture, fiduciary, or legal partnership relationship between the affiliate and The Tickle Box.

The use of terms such as “partner,” “partnership,” “affiliate partner,” or “creator partner” in program communications or marketing materials is intended solely to describe the affiliate's participation and collaborative relationship with The Tickle Box and does not create a legal partnership or agency relationship.

Affiliates do not have authority to enter into agreements, make commitments, incur obligations, or make representations on behalf of The Tickle Box unless expressly authorized in writing.

Affiliates operate independently and are responsible for their own business activities, expenses, taxes, legal obligations, and regulatory compliance.

Permission granted under Section 13 to use an affiliate's content, name, image, likeness, voice, social-media handle, or other authorized materials does not create an employment, agency, partnership, joint venture, or other legal relationship beyond the limited rights expressly granted under these Terms & Conditions.

15. Program Changes

The Tickle Box may modify the affiliate program, including commission rates, discount structures, eligibility requirements, promotional opportunities, and these Terms & Conditions.

When appropriate, affiliates will be informed of material program changes through Shopify Collabs, email, or another reasonable communication method.

Continued participation after updated terms become effective constitutes acceptance of the revised program terms to the extent permitted by applicable law.

16. Suspension or Termination

Either the affiliate or The Tickle Box may end the affiliate relationship.

The Tickle Box may suspend or terminate participation for violations of these Terms & Conditions, fraudulent activity, misuse of promotional codes, misleading advertising, inappropriate brand representation, or other conduct that could harm customers, the affiliate program, or The Tickle Box.

Valid commissions earned before termination will be handled according to the program terms and applicable Shopify Collabs requirements.

Fraudulent, prohibited, canceled, refunded, or otherwise ineligible transactions are not payable.

17. Program Administration

Affiliate tracking, creator accounts, attribution, and certain payments are administered using Shopify Collabs.

Affiliates may therefore also be subject to applicable Shopify Collabs terms, policies, and requirements.

The Tickle Box does not control interruptions, tracking limitations, payment-processing delays, or other technical issues attributable to third-party platforms.
